The permitted time for the sale of alcohol is established in accordance with the requirements of the Federal Law of November 22, 1995 No. 171-FZ (as amended).

It is worth noting that the ban on the sale of alcohol, in addition to a certain time period, can also be set for some days. Time of sale of alcohol in Moscow and the region

The time for the sale of alcohol in Moscow, according to the above law, is set from 8 am to 11 pm. The time for the sale of alcohol in the Moscow region, according to the decision of the Moscow City Duma of December 24, 2014, was extended and set for a period coinciding with the city of Moscow. The same restrictions apply to the sale of alcohol in the suburbs.

The time of sale of alcohol in St. Petersburg and the Leningrad region

The time of the ban on the sale of alcohol in St. Petersburg, according to the decision of the Legislative Assembly of St. Petersburg, adopted in January 2014, is set for the period from 22:00 to 11:00.

The permitted time for the purchase of alcoholic beverages in the Leningrad Region is set for the period from 9 am to 10 pm.

Time and features of the ban on the sale of alcohol in other regions

According to the above Law, the ban on the sale of alcohol at night is established for the period from 23:00 to 08:00. At the same time, the local authorities retain the right to change the specified time period.

It is worth noting that the ban on the sale of alcoholic beverages, in addition to restrictions on holidays at night, also applies to a number of public holidays, namely:

  • June 1 - Children's Day;
  • September 1 - first call;
  • May 25 - last call;
  • on the days of the graduation balls;
  • June 27 - Youth Day;
  • September 11 is sobriety day.

In addition, the leadership of the Ulyanovsk region has established an additional ban on the sale of alcoholic beverages on all weekends, as well as June 12 (Russia Day) and September 12 (local holiday - Family Communication Day).

Remember that the ban on the sale of alcohol applies to all shops, supermarkets and points of sale of alcohol.

Supermarkets and retail chains sale hours

There is an opinion that large retail chains, alcohol markets and supermarkets, such as Pyaterochka, Perekrestok, METRO, Bristol, Magnit, Auchan, Disks, Lenta, OKAY, SPAR (SPAR), Radezh, ESSEN and others, the law is not written, and alcohol is allowed there purchase at any time of the day. Actually it is not. Any trading enterprise is subject to federal and local laws of the region in which it is located. And this means that the hours of sale of alcohol do not depend on the name of the store, but strictly comply with the requirements of the law ...

Since 2012, federal legislation (clause 9, article 16 of the Law "On State Regulation of the Production and Turnover of Ethyl Alcohol ..." No. 171-FZ dated November 22, 1995) has established that the sale of any alcohol is prohibited throughout Russia in the period from 11 pm until 8 am. However, the same law states that local authorities can establish their own, even more stringent, standards - and here everything depends on the position of the regional authorities.

The fantasy of legislators at the level of the constituent entities of the Russian Federation (and Moscow as a city of federal significance, like St. Petersburg and Sevastopol, is not just a city, but a separate entity at the level of a region or a republic) can run wild. For example, in the Belgorod Region it is forbidden to sell alcohol from 10 p.m. to 10 a.m. (clause 1 of Article 2 of the Law of the Belgorod Region dated April 28, 2016 No. 71), in the Moscow Region - from 11 p.m. to 8 a.m. on the basis of federal legislation (previously established by the law of the Moscow Region dated 04/27/2012 No. 40/2012-OZ, the time limit from 21 to 11 was canceled), in Arkhangelsk - from 21 to 10 in the morning, and on some days (September 1, Children's Day, graduation days and youth day) even from 13:00 to 10:00 the next day (paragraph 1 of the Decree of the Government of the Arkhangelsk Region dated 05.06.2012 No. 222-pp).

In other regions, of course, their own restrictions may also be adopted. Therefore, if you are going on a visit to another city, ask in advance what time you can buy alcohol there.

From what time is the ban at night on the sale of alcohol in Moscow

In Moscow itself, a federal norm is still in force - a ban on the sale of alcohol from 23:00 to 08:00 the next day. However, even from these norms there are exceptions - and also at the all-Russian level.

All the same federal law No. 171-FZ directly states that these norms apply only to the retail sale of alcohol and do not apply to restaurants, bars, pubs and other places formally classified as public catering establishments. For them, you need to take into account other rules, according to which sales are allowed after 23:00:

  • strong alcohol - only for legal entities;
  • beer, mead, low-alcohol drinks - to entrepreneurs too.

In addition, the requirements of the law do not apply to duty free shops operating at airports - alcohol is sold there around the clock. However, only air passengers can use these shops.

Where the sale of alcohol in Moscow is absolutely prohibited

In Moscow, as in all of Russia, alcohol is never sold:

  • near children's, medical and sports facilities;
  • in cultural organizations (with the exception of buffets and other food outlets operating under these organizations);
  • at railway stations, airports and other places where there is both a mass gathering of citizens and an increased danger from transport (this does not only apply to the sale of alcoholic beverages in cafes / bars at railway stations and the already mentioned duty-free shops);
  • at military installations and territories adjacent to them;
  • in stalls, tents and other commercial facilities that are not stationary.

In addition, it is prohibited anywhere and at all times to sell any alcoholic beverages to minors. The seller, if he has doubts, has the right to demand a document confirming the identity and age from any buyer. Moreover, even if the minor looks older than his age and the seller will release alcohol to him, it will still be a violation of the law.

The depressing statistics prompted Russian legislators to tighten the Federal Law. According to the State Statistics Service and the Ministry of Health, Russia is rapidly getting younger, the consumption of alcohol and the number of offenses committed while intoxicated are constantly growing. Deputies of the State Duma of Russia decided to limit the sale of alcohol in Russia in 2019 in a special supplement to the law.

Amendments to the latest version of Federal Law No. 171-FZ, which regulates the circulation of alcohol in Russia, came into force in January 2017. In particular, time limits for the sale of alcoholic beverages have been introduced. It is expected that this measure will have a positive impact on the reduction of crime, the improvement of the nation, and the reduction of alcohol consumption.

What time is it allowed to sell alcohol in Russia?

Paragraph 5 of Article 16 stipulates a period of time for the sale of beer, weak and strong alcohol. In particular, at the all-Russian level, retail outlets are prohibited from selling alcohol-containing drinks from 23 pm to 8 am.

It is allowed to sell alcohol after 23:00:

  1. In public catering establishments with specially equipped rooms for visitors;
  2. In the duty-free zone at airports and border points.

According to the Law, regional authorities are authorized to adjust the time for the sale of alcohol in Russia in a stricter direction. The local authorities of individual regions have gone further and introduced significant restrictions or a complete "alcohol" ban on the red days of the calendar.

Many regional governments took advantage of the powers and increased the period of "sobriety". In the Primorsky Territory, the city of Artem, it is forbidden to sell alcohol from 22:00 to 9:00 in the morning. Regions with a valid ban for the period of 22.00-10.00 hours:

  • Cities Vyshny Volochek, Essentuki, Izhevsk, Kazan, Kaluga, Pikalevo, Muravlenko, Strezhevoy, Udomlya;

In the Altai Territory, Ivanovo, Irkutsk, Lipetsk, Vladimir regions, the cities of Tulun, Shuya, alcohol is sold only from nine in the morning until 21.00 in the evening. In the city of Aleksin, on weekends, alcohol is sold only from 14.00 to 22.00.

In the Chechen Republic, alcohol is sold only two hours a day from 8.00 to 10.00 daily, except for Muslim holidays.

In some regions, the authorities took care of sober weekends by limiting or completely banning sales on these days. In the Kirov region, the city of Kirovo-Chepetsk on weekends and holidays, alcohol can be bought from 10.00 to 17.00. The Ulyanovsk authorities generally banned the sale of alcoholic beverages on Saturday and Sunday. Alcohol is not sold on youth day in the Komi Republic.

The ban applies to all retail outlets. Takeaway sales are prohibited in catering establishments.

The time of the ban and the start of the sale of alcohol in Moscow

In December 2014, the Moscow City Duma issued a resolution to stop the sale of alcohol-containing products from 23.00 to 08.00 the next day in all trade enterprises. Cafes and restaurants are not subject to the ban with the condition of no takeaway trade.

The decision of the Moscow City Duma on the sale of alcohol in a strictly stipulated time is valid on the territory of the Russian capital and the Moscow region.

Under completely alcohol-free zones fall:

  • Market squares of retail and wholesale trade;
  • Military and strategic facilities;
  • Sports facilities, especially during competitions;
  • Railway, bus stations, airports and other passenger transport enterprises;
  • Production facilities, especially those associated with hazardous production;
  • Venues for public events with at least 100 participants;
  • Territories adjacent to kindergartens, schools and other educational institutions;
  • Hospitals, polyclinics, health resorts, sanatoriums and other medical and recreational institutions.

Local authorities independently regulate the permissible boundaries of places where the sale of alcoholic beverages is restricted. It is expected that schemes with borders and nearest retail outlets will be published on city portals. By the way, the Supreme Court issued a decision clarifying a number of incidents:

  • It is forbidden to sell alcohol in stores located in the non-residential levels of high-rise buildings if the entrance to outlet located on the side of the courtyard with a children's playground;
  • In parks, forest areas and urban gardens intended for tourism, sports. The exception is cafes and restaurants;
  • Catering establishments undertake to equip special premises for visitors with at least six tables for consumption on site.

Responsibility for violating the "alcohol" prohibition

Control over the implementation of the Federal Law on state regulation of the sale of alcoholic beverages is entrusted to supervisory agencies. The Administrative Code provides for the imposition of penalties on trading enterprises and responsible persons.

The Administrative Code does not provide for the application of penalties to citizens who buy alcohol from the wrong time.

Part 3 of Article 14.16 of the Code of the Russian Federation provides for the following types of penalties for the sale of alcohol at night:

  1. The general director of a trading enterprise or a trading network - a fine of 5-10 thousand rubles;
  2. Legal entities are subject to penalties in the amount of 50 -100 thousand rubles.

The law on the sale of alcohol, also known as the Federal Law of November 22, 1995 N 171-FZ, was adopted in Russia not by chance. Due to the fact that such measures have already been taken, the question of when it is forbidden to sell alcohol is of interest to both those who sell it and those who plan to consume it. Of course, there is a special law on the sale of alcohol, but not everyone bothers to open it and understand everything. Below is all the information in a more accessible and understandable form.

The concept of "alcohol"

In order to competently use and be guided by the law on the sale of alcohol, it is necessary to clearly understand what exactly falls under the concept of "alcoholic beverage". The law we are interested in is Federal Law No. 171-FZ of November 22, 1995. In fact, all drinks that contain 0.5% ethyl alcohol or its fermentation products are officially alcoholic - Art. 2 FZ-171. However, there is a small influx. This concept does not include all products in which the percentage of alcohol does not exceed 1.2%. For example, in such small quantities, alcohol can be found in fermented milk products (kefir, tan, koumiss), as well as in kvass. It is worth noting that some types of kvass contain even more alcohol than 1.2%, but they are still not classified as alcoholic beverages.

By product type

In addition, all products that are officially positioned as non-alcoholic and have passed the appropriate test do not fall under the law on the sale of alcohol. The most common options for this are non-alcoholic beer and non-alcoholic wine. They usually still contain ethanol, but its share rarely exceeds half a percent, and therefore such drinks are not subject to the said Federal Law.

The main list of alcoholic beverages is specified in the above-mentioned federal law and other by-laws. To put it simply, any liquid that contains alcohol is officially covered by the law on the sale of alcohol. In particular:

  • wine;
  • liquor;
  • port wine;
  • whiskey;
  • cognac;
  • vodka;
  • brandy;
  • absinthe;
  • tequila;
  • Calvados;
  • any tinctures for alcohol;
  • beer.

Beer

Beer is worth a separate stop. Many, for some reason, believe that beer is not subject to the law on the sale of alcohol due to its low alcohol content. The same is often thought about various low-alcohol products, alcohol-based energy drinks, and so on. As a rule, the alcohol content in such drinks is at the level of 3-4% or even higher, so there is no reason to make an exception for them. From the legal point of view of the law in question, the sale of 3.5% beer is equivalent to the sale of 70% chacha. But you need to understand that for the sale of beer there are exceptions specified in other regulations. Normative base

The law on the sale of alcohol, which, by the way, was amended in 2020 (came into force on 08/06/2017), is the main regulatory act that regulates the sale of any alcoholic beverages.

One of the most important points of this law is to limit the age of persons to whom alcohol can be sold. In any instances, it is 18 years. An exception is made only for those cases when a person officially married, or opened his own private enterprise. In such cases, he is officially considered an adult, and capable of taking responsibility for his actions. However, even in the case of presenting, for example, a marriage certificate, shop assistants very often refuse to sell alcohol to a client.

Requirements for the premises and documents

Another very interesting point of the law is the limitation of the area of ​​premises in which alcohol can be sold. The Prohibition of Alcohol Sale Act prohibits the sale of alcoholic beverages in an establishment with an area of ​​less than 50 square meters. Outside the city limits, this limit is reduced to 25 square meters. This information is regulated by various articles of the law, but in fact, for understanding, it is worth immediately studying 278-FZ - it is in it that the main amendments regarding changes in part of the premises are spelled out.

It is worth noting that there have always been enough people in Russia who wanted to circumvent the law on the sale of alcohol. A common scheme is an attempt to buy alcohol over the Internet. At the same time, the courier brings the client not only the drink directly, but also the lease agreement, which is a cover. According to this document, alcohol is allegedly rented to a person as a decorative element. At the same time, according to the contract, the recipient does not have the right to damage or open it. However, now this scheme is already being cracked down by law enforcement officers without any problems. The lease agreement is recognized as having been drawn up to hide the real contract of sale, after which the selling company is held liable. In some cases, even the buyer can be attracted if he was directly involved in the implementation of the scheme, fully aware of the fact that this is illegal.

It was also established a strict restriction on the sale of alcohol in the hands of persons under the age of 18 years, that is, minors. With regard to the release time of alcoholic products, this regime may vary depending on the established rules of local authorities.

In order to depopulize alcohol and reduce the volume of its consumption in our country, legislative acts regulating the sale of alcohol-containing products were approved. For residents of the Moscow region, there are stricter limits: sales are allowed from 11 am to 9 pm and, accordingly, are prohibited from 21.00 to 11.00. For the period of 2020, the time frame for selling alcohol in Moscow and the Moscow Region is from 08.00 to 23.00.

The ban on the sale of alcoholic beverages at night is a state-level measure to combat addiction. In the Moscow region, the Law of April 27, 2012 No. 40/2012-OZ "On retail alcoholic products in the Moscow region. According to article 2 of this law, the Moscow Regional Duma has the right to impose restrictions on the sale of alcohol, including a complete ban on the sale of alcohol to the population. However, now there is no norm on the time of sale of alcohol in the regional law.

How much and how much alcohol is sold in Russia

Some regions went further and expanded the list on which days alcohol is not sold. For many, this is the Holiday of the city (village, municipal association). In Buryatia - the national Surkharban.
