The Tax Service of the Russian Federation has launched a new project, the purpose of which is to change the rules for using cash registers. Instead of classic cash desks and terminals, verifications, a call log for a service specialist, etc., there should come cash desks that automatically transmit data to the tax office through specialized intermediaries, and in addition to the usual paper check, the buyer can receive its electronic version in the form of SMS or e-mail.

The paper versions of the fiscal document will be printed with a QR code and a link for checking information about the purchase on the tax website through a mobile phone application or a computer.

What are the main advantages of online cash registers for an entrepreneur?

  • Simplified registration of cash registers through the personal account of the taxpayer on the website nalog.ru. No more need to take the cash register to the tax office, waste time in queues;
  • Less chance of field inspection if data is received continuously;
  • The requirement to replace the control tape once a year is eliminated. Now the fiscal drive can be changed independently once every three years for the simplified tax system and once a year for the OSNO.   • The journal of the cashier-operator and its filling with dozens of fields is cancelled;
  • It is not necessary to conclude a contract for the maintenance of a CCP, and, consequently, to maintain related documents;
  • The Federal Tax Service takes into account all models of cash registers issued by manufacturers according to serial numbers, which simplifies their control.

How do online cash registers work?

According to the new law, the following principle of operation of cash registers is established:

  • You buy a cash register or upgrade an existing one. The main difference from the old cash registers is the presence of a memory block in it, which is called a fiscal drive. It is encrypted and data on all operations carried out through this device are recorded on it. The second difference is the interface for transmitting information over the Internet.
  • Each transaction with the issuance of a check (whether electronic or paper) will be recorded in the memory of the fiscal drive and sent through the network to fiscal data operators (FDOs), which check the correctness of the data and confirm their receipt, returning data on the accounting of the operation for the buyer and the check. If there is no connection to the network, then only a memory entry is made, and online checks are posted when the connection is restored.
  • Further, OFD transmit data directly to the tax office, which records transactions in an automated mode.
  • The buyer can at any time check whether it was registered and carried out through a tax transaction using a unique transaction number or a QR code. If there is no transaction, then you can file a complaint with the Federal Tax Service.

Who must use online cash registers under the new law?

Along with the simplification of interaction, the list of those who are obliged to use the new type of CCP is also expanding.

The right to sell goods and provide services without issuing a check and using cash registers has been lost:

  • Organizations that applied the Single Tax on Sane Income (UTII);
  • Organizations and individual entrepreneurs that used the patent system of taxation;
  • Trading with the use of payment terminals, cashiers;
  • Trade through vending machines;
  • Entrepreneurs providing services to the public and previously issued BSO.

What will happen to the BSO?

Forms of strict reporting of the current sample, which are ordered in printing houses or bought in stationery stores, can be used until the 3rd quarter of 2018. After this milestone, BSOs will be issued by the same automated systems as checks, and transaction data will be transferred to tax inspectorates.

How much does it cost to transfer to an online checkout?

There are two options for switching to a new type of technology.

  • You already have a cash register and you can upgrade it by installing a fiscal drive in it. If the cash register already has access to the Internet or a connection interface with a computer, then most likely your cash register is subject to modernization. 54-FZ. New procedure for applying CCP from 2018

  • Only individual entrepreneurs who sell goods of their own production, perform work or provide services and do not have employees on employment contracts received a deferment from online cash desks until 2021. In addition, couriers were relieved of the obligation to punch checks, that is, there is no need to carry cash registers with you, you can use it remotely.   • Since 2017, the scheme of work of trade organizations with the tax has changed - after amendments to the law 54-FZ "On the use of cash registers". Changes concern the majority of entrepreneurs. The new procedure for the use of cash registers assumes that sales data from each knocked out check must be transmitted to the tax office via the Internet through a fiscal data operator (OFD). With such an operator, you need to conclude an agreement.
  • Entrepreneurs can now only use cash registers with a fiscal accumulator (FN). FN is needed to record and store information about the calculations that are carried out on the CCP. All cash registers allowed for use are included in the register of the Federal Tax Service.   • You can register an online cash desk at the tax office via the Internet, but only after signing an agreement with the OFD. But you can no longer apply to the CTO. The obligatory conclusion of an agreement with the maintenance center is no longer required to use the CCP. The entrepreneur himself decides whether to choose a central service center or another service center or do everything on his own.

  • Although the transfer of data to the tax office has become an online procedure, Law 54-FZ “On the Application of Cash Registers” does not contain provisions that it is not necessary to issue a paper check in 2020. At the request of the buyer, you need to send him a document by email or SMS in addition to the one printed on the CCP. An electronic check is equivalent to a paper one. In this case, the courier may not punch through the cash receipt. It is enough to show the buyer a QR code, by which an electronic one is downloaded. You do not need to carry a cash register with you: it is allowed to use it remotely.
  • Since 2018, the CCP Law has required more data to be indicated in checks and strict reporting forms. For example, a list of punched goods (with prices, discounts), the factory number of the fiscal accumulator and the phone number or email of the buyer, if the document is transmitted in electronic form.   • Entrepreneurs on a patent and UTII were also affected by changes in 54-FZ: since 2018, they also began to set up cash registers, although earlier they were generally exempted from using cash registers. Only individual entrepreneurs who sell goods of their own production, perform work or provide services and do not have employees on employment contracts received a deferral for online cash desks until July 1, 2021.   • The cost of purchasing cash register equipment can be deducted from the tax - up to 18,000 rubles for each device. But not everyone.

  • You can also deregister a CCP without visiting the tax office - through your personal account on the website of the Federal Tax Service. But the tax can do it forcibly.
  • Checks from payments to the current account. From July 1, 2019, an entrepreneur is obliged to knock out a cashier's check when payment is received from an individual to the organization's settlement account.
  • Prepaid checks. From July 1, 2019, you need to knock out two checks. One - upon receipt of an advance payment, and the second - upon the transfer of goods or the provision of services. The good news is that it's very easy in My Warehouse.

The use of cash registers in 2020 - how it looks in practice

When the cash register is registered, the seller starts working with it. The use of CCP in 2020 as a whole does not differ from the usual work. The buyer pays for the goods and receives a check - now also electronic. The fiscal registrar sends information about the sale or return to the fiscal data operator. OFD processes the information, sends confirmation back to the cashier, and the data to the tax office. All information is transmitted in parallel with the issuance of a check, that is, the customer service time does not change.

New rules for the use of cash registers in 2018 helped the state to make trade transparent. But for entrepreneurs, re-equipment of the cashier's place is an additional cost. What threatens the improper use of cash registers in 2020?

The tax authorities have already issued the first fines for violating the requirements of 54-FZ. For non-use of a new cash register, an entrepreneur can be fined 25-50% of the amount spent past the cash desk, but not less than 10,000 rubles. Organizations - by 75–100%, but not less than 30,000 rubles. For the use of a cash register that does not comply with the requirements of the law, an individual entrepreneur faces a fine of up to 3,000 rubles, and a company - up to 10,000 rubles. In the event of a repeated violation, if the settlement amount exceeds 1 million rubles, the activities of the entrepreneur or organization may be suspended for up to 90 days.

Since July 1, 2018, there have been more fines for the incorrect use of cash registers. Amendments have been made to the Code of Administrative Violations - now they will also punish fictitious checks of cash registers. From companies they will be able to recover up to 40,000 rubles, from individual entrepreneurs - up to 10,000 rubles. The Federal Tax Service will also be able to fine for incorrectly indicated marked goods on a check or untimely transfer of fiscal data: organizations in the amount of up to 100,000 rubles, entrepreneurs - up to 50,000 rubles. If the individual entrepreneur or company is caught in violation again, and the settlement amount is more than 1 million rubles, the fine will be from 800,000 to 1 million rubles.

In addition, the tax authorities will have the right to block the work of cash desks that were used in violation. This will be possible in the presence of two witnesses or with the use of video recording.

The use of CCP with the simplified tax system in 2020

For individual entrepreneurs, the use of cash registers under the simplified tax system in 2018 was necessary, as well as for legal entities. The right to defer until July 1, 2019 was granted only to those companies and entrepreneurs on simplified taxation that provide services to the public. Since 2017, organizations and entrepreneurs must use online cash registers. The relevant Law entered into force in July 2016 (Part 1, Article 7 of Law No. 290-FZ of July 3, 2016). But the transition to online cash registers was gradual.

Law on online cash registers: what is the essence

The law obliges organizations and individual entrepreneurs to use CRE models with fiscal data drives (Article 1.1 of the Law of May 22, 2003 N 54-FZ). With the help of the new cash registers, information about completed transactions in cash or using electronic means of payment will be transmitted through fiscal data operators to the tax authorities online. According to the Law on Online Cash Desks, in order to become such an operator, a Russian organization must obtain the appropriate permission to process fiscal data.

Accordingly, today many organizations and individual entrepreneurs have to purchase such online cash registers. Their prices differ, of course. At the same time, in order to comply with the requirements of the new Law on Online Cash Desks, it is not necessary to completely change the equipment, some devices can be upgraded.

From 08/19/2017, firms and individual entrepreneurs using online cash registers are in some cases required to communicate with the IFTS on “cash” issues only through the CCP Internet account. And at the same time observe certain deadlines, otherwise there may be a fine. Online cash registers for those who have the right not to use cash registers

Those organizations and individual entrepreneurs who, prior to the entry into force of the commented Law, had the right not to apply the CCP, and then may not apply it until July 1, 2018 (part 9 of article 7 of the Law of 03.07.2016 N 290-FZ). That is, moneychangers, entrepreneurs who apply the patent taxation system (part 7 of article 7 of the Law of 03.07.2016 N 290-FZ) have such a right, as well as those who trade using vending machines (part 11 of article 7 of the Law of July 3, 2016 N 290-FZ). True, if an individual entrepreneur trades through automatic machines and he has no employees, then he is exempted from the use of CCP until 07/01/2019. Also, until this date, organizations and individual entrepreneurs that perform work, provide services to the public (except for organizations and individual entrepreneurs with employees with whom labor contracts have been concluded that provide catering services) may not apply the CCP and draw up a BSO (part 8 of article 7 Law of July 3, 2016 N 290-FZ).

Law on online cash desks: what has changed for the consumer

When making payments, the seller, as before, must issue the buyer a cash receipt or a strict reporting form on paper. But if, before the moment of settlement, the buyer informs the seller of his subscriber phone number or email address, then the online cash desk will send him a check or BSO in electronic form - to the phone or e-mail (clause 2 of article 1.2 of the Law of 05.22.2003 N 54- FZ).

The tax service comments on this innovation as extremely positive for consumers. After all, having received an electronic cash receipt, the buyer may not be afraid to lose it, which is important from the point of view of consumer protection. On the other hand, not every client will agree to provide their phone number or e-mail to the seller for fear of receiving a new portion of advertising messages.

When implementing control functions in the field of cash registers (hereinafter referred to as cash registers), the tax authorities are guided by the use of a risk-based approach, which, under the current regulatory framework, made it possible from 2011 to 2015 to reduce the number of inspections from 278 to 173 thousand, or by 38% and at the same time increase their performance from 54 to 86 per cent.

At the same time, the current level of technology development makes it possible to significantly simplify the current procedure and at the same time increase its efficiency, both for taxpayers and tax authorities, as evidenced by world experience.

In order to improve the current order - costly, laborious and administratively inconvenient - the idea of ​​reforming it based on the use of modern automated systems was proposed.

On July 15, 2016, Federal Law No. 290-FZ “On Amendments to the Federal Law “On the Use of Cash Registers in Cash Payments and (or) Payments with Payment Cards” and certain legislative acts came into force Russian Federation».

The law provides for the following main provisions:

  1. Transfer of information on settlements through fiscal data operators to the Federal Tax Service of Russia.
  2. Possibility to carry out all registration actions with cash registers and other legally significant document flow on the application of cash registers through a personal account on the website of the Federal Tax Service of Russia.
  3. Production of cash receipts and strict reporting forms exclusively by cash registers with the possibility of sending them in electronic form to the subscriber number or e-mail of the buyer. The strict reporting form is equated to a cashier's check.
  4. The use of cash registers in the provision of services, as well as by payers of a single tax on imputed income and a patent.
  5. The use of a fiscal drive (an analogue of a secure electronic control tape) with the possibility of its independent replacement once every 3 years by UTII and patent payers, as well as the service sector. The deadlines for the use of the fiscal accumulator are not limited by law.
  6. Maintenance is not necessary for registering a cash register with the Federal Tax Service of Russia.
  7. Examination of manufactured cash registers and technical means of fiscal data operators.
  8. Instance accounting of the Federal Tax Service of Russia of manufactured cash registers and fiscal drives in the form of registers.
  9. Possibility of using CCP offline under certain conditions.
  10. New forms of control measures, the possibility of requesting information on accounts from banks during operational checks.
  11. Smooth and phased transition to a new procedure for the use of CCP. So, from July 15, 2016, the possibility of a voluntary transition to the new procedure is provided, from February 1, 2017, registration of cash registers will be carried out only according to the new procedure, and from July 1, 2017, the old procedure will cease to be valid. At the same time, service sector enterprises, owners of vending machines, as well as persons applying a patent and UTII, that is, for small businesses that were not obliged to apply CCP, will have another whole year to switch to the new order, for them it becomes mandatory from 1 July 2018.

The main provisions of the proposed system are:

  1. Transfer of information on settlements in electronic form to the tax authorities through the operator of fiscal data.
  2. Electronic registration of cash registers without visiting the tax authority and without physical provision of cash registers.
  3. Building a system for guaranteed detection of violations based on automated analysis of information on settlements, identification of risk zones for committing offenses and conducting targeted effective checks.
  4. Involvement of buyers in civil control.

To test the proposed technology, an experiment was conducted in accordance with Decree of the Government of the Russian Federation dated July 14, 2014 No. 657 “On conducting an experiment in 2014-2015 ...” using the technology for transferring information about settlements to the tax authorities.

The purpose of the experiment is to determine for organizations and individual entrepreneurs the financial efficiency and ease of use of information transfer technology, as well as the technical capabilities of operating CCP and information transfer technology.

The experiment was conducted within six months from August 1, 2014 in four subjects of the Russian Federation: in Moscow, the Moscow region, the Republic of Tatarstan and the Kaluga region.

The experiment showed both the financial efficiency of the technology for transferring information about settlements for organizations and individual entrepreneurs during the transition to the proposed procedure for using cash registers, and the convenience of using this technology. At the same time, the technical possibilities of operating the technology for transmitting information about calculations are proved.

The experiment involved taxpayers of various types and scales of activity: both large retail chains and individual entrepreneurs. At the same time, along with taxpayers who are obliged to use CRE, the experiment involved taxpayers who are not required to use CRE, for example, those working in the provision of services.

The experiment was completed on February 1, 2015, however, at the request of the taxpayers participating in the experiment, by Decree of the Government of the Russian Federation of June 3, 2015 No. 543, they were granted the right to register cash registers and work using the new technology until the end of 2015. By Decree of the Government of the Russian Federation No. 1402 dated December 22, 2015, the participants in the experiment were granted the right to use CCP using the new technology until the end of 2016.

To date, 3.5 thousand units of cash registers have been connected to the tested technology, 50 million checks worth 40 billion rubles have been punched.

  5. get rid of checks, since prompt receipt of information about settlements provides an appropriate environment of trust;
  6. operate in a fair competitive business environment by preventing unscrupulous taxpayers from illegally minimizing their tax liabilities and unfairly gaining a competitive advantage.
The new technology provides a citizen with additional protection of his rights as a consumer due to the possibility of:
  1. receive an electronic receipt from the fiscal data operator and (or) in your e-mail;
  2. independently quickly and conveniently check the legality of a cash receipt through a free mobile application and, in case of questions, immediately send a complaint to the Federal Tax Service of Russia.

From the point of view of the state, legalization of retail trade and the service sector is expected and, accordingly, an increase in tax revenues, as well as optimization of labor costs through the transition to electronic registration and focusing the attention of tax authorities on risk areas.

For some, the transition period may come even earlier! From March 31, 2017, those who sell alcoholic products can only do so using a cash register. We will break the whole process of changing the old-style cash desk into several steps. So, you should start with preparatory measures, then purchase a new device or upgrade an old one, and, finally, register a new CCP with the tax authorities.

Step 1: We study the law on the use of cash registers and establish whether you need to use a cash register in your activities, and also when exactly this obligation to use it comes.

OFD - an intermediary between the seller and the tax authorities, which ensures the transfer of data on revenue. Only a Russian company that has a permit for such activities can act as an OFD.

Step 8: We put a new / updated cash register on record with the tax office.

Here the sequence of actions looks like this:

  1. We draw up and submit an application for registration of CCP. This can be done either online through the CCP office on the website of the Federal Tax Service (an electronic signature is required), or in paper form at any tax office (previously you could only go to your own).
  2. The tax office tells you the registration number of the CCP, which will not change during the entire period of using the device.
  3. You write this number to the fiscal drive. You will also need to specify other data, for example, the name of the organization or full name of the individual entrepreneur and other details. After filling in all the required information, you need to generate a registration report and submit it to the tax office. This can already be done in three ways: on paper, electronically through the CCP office or through the OFD. These actions must be carried out no later than the business day following the day of receipt of the registration No. from the tax service.
  4. Within 5 working days, the tax authorities register the cash register and send you a registration card. You receive it through the KKT office or OFD in electronic form, if you need a paper version, contact the tax office, where you should print it out.
